FOUR QUALITIES TO CONSIDER

Four qualities that make Jack Kennedy the best choice for District Court Judge are his broad-based legal experience, his personal and professional integrity, his compassion for others, and his  commitment to justice.

EXPERIENCE:  Jack possesses an in-depth understanding of civil procedure, having represented both plaintiffs and defendants in civil proceedings throughout his 30-year legal career.  Though his employment law cases have garnered the most press, Jack is also well known for his work in personal injury, wrongful death, real estate and business law.  Having devoted much of his early career to family law and criminal defense, and having served as a court-appointed arbitrator, Jack Kennedy has the depth and breadth of legal experience necessary to effectively serve the Third Judicial District Court.   

INTEGRITY:  Jack is personally funding his campaign because he believes that a judicial candidate should not solicit financial contributions from those who may someday appear before the Court.  Private citizens and businesses alike should be free from doubt as to their equal standing when they enter a courtroom.  Regardless of a presiding judge's ability to not allow a campaign donation to influence his or her rulings, the perception of judicial bias will undoubtedly cast its shadow.  As a self-funded candidate for Third Judicial District Court Judge, Jack Kennedy will be fair, impartial, and unbiased.  Jack is dedicated to upholding the integrity of the legal system and the Nevada Code of Judicial Conduct.

COMPASSION:  Having represented both sides in the courtroom, Jack is acutely aware of the toll that the civil litigation process can take on both plaintiffs and defendants.  The personal and financial consequences of litigation are compounded when the process is delayed.  The same is true for those with pending family court matters.  By improving the efficiency of the Court, all types of matters (whether civil, family or criminal cases) can be concluded sooner, thereby reducing the cost of litigation and enabling closure.

COMMITMENT:  Jack Kennedy is committed to improving the Third Judicial District Court through hard work, communication, innovation, and implementation.  

  • HARD WORK - Increased priority must be given to motion practice, and the necessary time must be committed to ensure all pending issues are reviewed and ruled upon in a timely manner.  This will enable more trials to go forward as originally scheduled.  

  • COMMUNICATION - Formation of a Bench-Bar Committee to discuss methods of improving the efficiency of the Third Judicial District Court and to identify deficiencies within the system will help streamline the legal process.  Idea sharing with other court systems will help identify effective solutions.

  • INNOVATION - Utilizing an electronic filing system, such as the one pioneered by the U.S. District Court, would significantly benefit the Third Judicial District Court.  Similar systems are now being adopted for use by other Nevada District Courts.  In addition to the natural resources that are saved by electronic filing (reduced paper usage, reduced fossil fuel consumption), Third Judicial District Court Judges would have 24-hour, on-line access to every active case on file before them regardless of which county it is filed in.  This would greatly improve the Court's ability to review pending motion practice, decide emergency motions, and resolve urgent discovery conflicts.  Travel-related document filing costs and fees would be reduced for both plaintiffs and defendants.  Attorneys could prepare and file those documents eligible for electronic filing from anywhere in the world with internet access.

  • IMPLEMENTATION - Adoption and implementation of the Court-Annexed Arbitration Program would greatly benefit the Third Judicial District Court.  Several years ago, the Nevada Supreme Court developed a court-annexed arbitration program whereby most civil cases (not otherwise excepted) that had a probable jury award value of less than $40,000.00 would be subject to mandatory arbitration (this maximum threshold was recently increased to $50,000.00).  While participation was mandatory for judicial districts having a population of at least 100,000 persons, judicial districts (such as ours) having a lesser population were given the option of adopting local rules implementing all or part of the program.  As of now, the Third Judicial District Court has not adopted this program.  With the rapid growth our counties have experienced, our participation will be mandatory within the next few years, but we could already be reaping the benefits of this program.  Mandatory arbitration would enable a cost-effective means of resolution for many of the cases filed with the Churchill and Lyon County District Courts.  Since the arbitration program utilizes specially-trained attorneys to act as arbitrators, whose fee is shared equally by the parties to the action, our Courts' limited resources could be preserved.  Within the six-month time frame between appointment of the arbitrator and the deadline to conduct the arbitration hearing, utilizing a simplified, cost-effective discovery plan, eligible civil cases can be concluded.  Any appeal of the arbitrator's ruling and/or award would be decided using the "Short Trial" program.
